These terms are an agreement between you and Members Of Us Limited (“YouPOLL”, “we”, “us”) for the YouPOLL apps and the website youpoll.app (the “Service”). By creating an account or using the Service you accept these terms, ourPrivacy policy and the rules in How YouPOLL works. If you don’t agree, please don’t use the Service.
1. Who can use YouPOLL
- You must be 16 or older, and allowed to use the Service under the laws that apply to you.
- Give accurate details when you sign up (including your year of birth) and keep them up to date.
- Keep your password private. You are responsible for what happens in your account.
2. One person, one vote
- You may have one personal account, linked to one phone. Your votes represent you as one person and can’t be changed once cast.
- A business account is separate, by subscription. It can’t vote or withdraw cash.
- Creating or using extra accounts, phones or tools to vote more than once, to change results or to collect rewards is not allowed, and leads to account closure, loss of rewards and, where appropriate, legal action.
- Votes made on the website count in a poll’s results (shown as “web votes”) but not in its detailed statistics, and earn no points or cash. One vote per browser; using other browsers or clearing cookies to vote again is not allowed.
3. Your content
- You own what you post. You give YouPOLL a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, adapt (for example resize) and distribute it, so we can run, show and promote the Service. The licence ends when you delete the content, except where others have already shared it or we must keep it by law.
- Only post content you have the right to post. Public content can be seen, shared and linked to by anyone.
- Anonymous posting hides your name from other users only. YouPOLL knows who posted, applies these terms in the same way, and may disclose it where the law requires.
4. What you must not do
- Post hate speech, or content that attacks people for their race, ethnicity, religion, gender, sexuality, disability or nationality.
- Harass, bully, threaten or impersonate anyone, or post someone’s private information without consent.
- Post sexual content, nudity, graphic violence, or anything illegal, including content that infringes copyright.
- Post spam, scams, or misleading or deceptive content, or links to malware.
- Break the law, or help or encourage anyone to.
- Interfere with the Service: hacking, probing for weaknesses, overloading, scraping or automated access we haven’t allowed.
5. Moderation and the three-strike rule
- We may review, hide or remove content, and limit or close accounts, to keep YouPOLL safe and lawful. Posts and comments are checked automatically, and content the check flags is hidden until a person on our team reviews it. Reports from users are reviewed by our team too.
- An offence only counts when a person on our team confirms it. Anonymous posts follow the same rules: we can see who posted them.
- Three strikes: a first confirmed offence brings a warning; a second, a last warning; after a third, we may delete the account and block its phone and email from creating new accounts. Serious or illegal content may lead to immediate closure and a report to the authorities.
- If you think we got it wrong, email [email protected] and we will look again. A block can be lifted after an appeal.
6. Polls, results and statistics
Results reflect the people who chose to answer. They are not scientific samples, and voters’ details are given by the voters themselves, so we can’t guarantee results, predictions or demographic data. Polls in categories such as Medicine or Law are for information and entertainment, not professional advice. Sponsoring buys targeted reach, not answers: responses to sponsored polls are voluntary and not guaranteed.
7. Points, cash and rewards
- Poll Points and cash rewards are earned and used as described in the app. Amounts are in euros. Their values, minimums and fees are shown in the app and may change; we will update them there.
- Poll Points are used to sponsor polls, at 10 Poll Points for each person reached, whether or not they answer. A cash reward on a sponsored poll is optional. Only business accounts can buy Poll Points, and bought Poll Points can never be turned into cash.
- When cash rewards are available, cash withdrawals are paid through PayPal to the PayPal email on your account, in blocks of €5, 7 days after you ask. The PayPal fee is shown before you confirm and is taken from the amount withdrawn. Withdrawals may be paused for 7 days after you move your account to a new phone or change your PayPal email, and may be held while we check for fraud. Any balance left when an account is deleted is lost.
- Rewards gained by breaking these terms (for example with extra accounts) can be removed, and they end when an account is deleted.
- Businesses offering cash on a poll pay for it with Cash Points bought in the app. Unpaid cash goes back to the business if the poll is deleted. If a purchase is refunded, the amount is taken back from the business, not from people who answered.
8. Purchases and subscriptions
- Purchases (Gold, Poll Points, Cash Points and business subscriptions) are made through the App Store or Google Play and follow their terms. Prices are shown in the store.
- Gold is a one-time purchase, not a subscription.
- Business subscriptions renew automatically until you cancel them in your App Store or Google Play account. Business features continue until the end of the period you paid for.
- Refunds are handled by Apple or Google under their policies. Your rights under consumer law are not affected.
9. Ads
Personal accounts (including Gold) see ads, which may be personalised if you allow it. Business accounts are ad-free.
10. Our rights in YouPOLL
The YouPOLL name, logo, apps and website belong to us or our licensors. We give you a personal, revocable, non-transferable licence to use the Service as offered. Don’t copy, reverse-engineer, resell or reuse it, or our brand, without our written permission.
11. Copyright complaints
If you believe content on YouPOLL infringes your copyright, email [email protected] with your contact details, the work concerned, where the content is on YouPOLL, a statement that you believe in good faith that the use is not authorised, and a statement that the information is accurate and that you own or act for the owner of the rights. We remove infringing content and close the accounts of repeat infringers.
12. Other websites
Polls, opinions and ads may link to other websites and services, including PayPal, Apple and Google. We are not responsible for them; their own terms apply.
13. Changes and ending
- We may change or stop features. We will post changes to these terms here with a new date and tell you about important ones in the app or by email. Continuing to use YouPOLL after a change means you accept it.
- You can stop using YouPOLL and delete your account at any time in Settings. We may suspend or close accounts that break these terms.
14. Disclaimer and liability
We work hard to keep YouPOLL running and secure, but the Service is provided “as is” and “as available”, without guarantees that it will always be available, error-free or meet your needs. To the extent the law allows, we are not liable for indirect or consequential losses, for content posted by others, or for losses caused by events outside our control, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can’t be limited by law, or your statutory rights as a consumer.
If someone makes a claim against us because of content you posted or your breach of these terms, you agree to cover our reasonable costs, to the extent the law allows.
15. Law and disputes
These terms are governed by the laws of Ireland. Disputes go to the Irish courts, but if you live elsewhere in the EU you may also use the courts and consumer protections of your own country. Please contact us first; most problems can be solved quickly.
